ANTI-DUMPING NOTICE NO. 2014/45

Silicon Metal exported from the People’s Republic of China Extension of time granted to issue the Statement of Essential Facts

Customs Act 1901 – Part XVB

On 6 February 2014, the Anti-Dumping Commission (the Commission) published a notice announcing the initiation of an investigation into the alleged dumping and subsidisation of silicon metal exported from the People’s Republic of China (China).

A full description of the goods is available in Anti-Dumping Notice (ADN) No. 2014/08. This ADN is available on the Commission’s website at www.adcommission.gov.au.

The initiation notice advised that the statement of essential facts (SEF) for the investigation would be placed on the public record by 27 May 2014. The SEF will set out the facts on which I propose to base my recommendations to the Parliamentary Secretary to the Minister for Industry (the Parliamentary Secretary).

Due to the complexity of the issues surrounding the investigation, as well as extensions of time allowed for various interested parties to supply information, I have requested an extension of the deadline for the publication of the SEF.

The Parliamentary Secretary has, under section 269ZHI of the Customs Act 1901, extended the deadline for the publication of the SEF. The SEF will now be placed on the public record no later than 25 August 2014. Interested parties are invited to make submissions to the Commission in response to the SEF within 20 days of the SEF being placed on the public record. A recommendation to the Parliamentary Secretary will now be made in a report due on or before 9 October 2014.

Documents included in the public record are available at www.adcommission.gov.au.

Alternatively, the public record may be examined at the Commission’s office by contacting the case manager on the details provided below.

Inquiries about this notice may be directed to the case manager on telephone number

02 6275 5649, or email operations2@adcommission.gov.au.
